Chapter 7 vs. Chapter 13
Our attorneys handle both Chapter 7 and Chapter 13 bankruptcy cases. A Chapter 7 bankruptcy is a debt liquidation bankruptcy that results in debts being discharged. Most debts, including credit card debts, medical bills and other unsecured debts can be discharged. To be eligible for a Chapter 7 bankruptcy, you must meet a means test.
Many of our clients find they are eligible for Chapter 7 relief. For those who are not eligible for a Chapter 7 bankruptcy, a Chapter 13 bankruptcy may be the answer. A Chapter 13 bankruptcy is a debt restructuring bankruptcy in which a person is allowed to pay back their debts in a more gradual fashion. Typically, the bankruptcy court will issue an order that calls for a three year or five year payment plan. In addition to reducing interest rates and increasing the time to make payments, a portion of the overall debt may also be discharged in some cases.
